The Environment Board at its meeting on 11 December 2012 resolved that the Outline Planning Brief for Le Bouet Mixed Use Redevelopment Area has expired by virtue of section 13 of the Land Planning and Development (Plans) Ordinance, 2007.
This provides that a Local Planning Brief has effect for 10 years from its date of adoption by the States unless extended by resolution of the States. It was concluded that the Brief, which was adopted in 1998 and had not been specifically extended by resolution of the States, expired on coming into effect of the 2005 Land Planning and Development Law in April 2009.
It was consequently proposed that in view of this the above planning application would be determined having regard to the Urban Area Plan but not the expired Outline Planning Brief. The Department therefore invited the applicants to submit a revised planning statement in view of the Department's decision on the OPB.
However, having further considered the matter, in order to rectify the current policy lacuna the Environment Department now proposes to report to the States with proposals for a Projet to reinstate the Outline Planning Briefs for both Le Bouet MURA and Glategny Esplanade MURA for a period of three years. The Glategny Esplanade MURA Outline Planning Brief was adopted in 1999 and had also not been specifically extended by resolution of the States. It is anticipated that the States Report and Projet will be considered by the States in February 2013 and if approved sent in the normal way for Royal Assent following which it would come into force. Once this proposed legislation is in place the current application will be considered having regard to the reinstated Outline Planning Brief for Le Bouet Mixed Use Redevelopment Area and other relevant material planning considerations. Any amendments made to the application will be publicised in the normal way.
