Vehicle width restriction in Rue de Bas is to become permanent

  • Who needs a Right to Work document?

    • (Almost) every person employed or self-employed in Guernsey must hold a valid Right to Work document. A Right to Work document proves that the holder is housed in compliance with the Housing Control Law.
       
    • People in employment before 1st December 1989 and still working for the same employer do not need to hold a Right to Work document.
       
    • The types of Right to Work documents that exist under the Right to Work and Housing Control Laws in Guernsey are detailed in the table under 'Types of Right to Work documents' below. Some Right to Work documents will specify certain conditions of the document - as set out in the table - which, if not adhered to, could invalidate the document.
  • Employer's responsibilities

    • By law, every employer is required to keep the following information about each of its employees:
       
      • Full name & date of birth (including previous names if during this employment)
      • Social Security Number
      • Job title and address of principal employment
      • Date employment commenced (if after 1st December 1989)
      • Home address
      • Details of Right to Work document (including description, reference number and expiry date (if any))
    • The employer needs to keep a record of:
       
      • any changes - and the date of any changes - to the above information
      • the date on which an employee's employment ceases
      • former employees until the 3rd anniversary of the date employment ceased
    • The records need to be kept in such a way that they can be readily reproduced (in alphabetical order by last name if more than 30 employees). The records will need to be kept at the physical place of work (if more than 5 employees work there permanently).
       
    • Employers would also be advised to contact the Social Security Department www.gov.gg/socialsecurity in respect of contributions to be made and the Income Tax Office www.gov.gg/tax.
  • Employee's responsibilities

    • An employee must notify Housing Control in advance (where possible) of any change in circumstances that invalidates their current Right to Work Document.
    • It is the responsibility of the employee to apply for a new document in advance of the expiry date of their current Right to Work Document.
  • Types of Right to Work documents

    • Document TypeExplanation
      Status Declaration         A document held by a 'Qualified Resident'.

      A Status Declaration never expires and there are no employment or housing conditions attached to the document.
      Housing LicenceA document held by people permitted to live in Guernsey because of their job or because of their connections with the Island.

      A Housing Licence has an expiry date and is linked to a specific address. It may also be linked to:

      - a specific full-time job with a named employer
      - living with a named person
      - the validity of another person's Housing Licence

      Depending on what type of housing licence it is, it may also prevent the holder from accommodating dependants.
      Declaration of Lawful ResidenceA document held by the family members of housing licence holders; some types of Open Market residents; or people living in States-owned dwellings.

      A Declaration of Lawful Residence has an expiry date and is linked to a specific address. It may also be linked to:

      - employment with a named employer
      - living with a named person
      - the validity of another person's Housing Licence
       
      Temporary Exemption CertificateA document issued when an application for a full Right to Work document is under consideration and in other specific circumstances.

      A Temporary Exemption Certificate has an expiry date. It may be also linked to an address, or employment with a named employer, or linked to living with a named person.
      Boat Crew DeclarationA document issued to people living and working on-board a boat.

      A Boat Crew Declaration has an expiry date and is linked to a specific boat moored in a specific location.
      Tent Dweller's DeclarationA document issued only between April and October for people working in horticulture or tourism.

      A Tent Dweller's Declaration has an expiry date, is linked to a specific campsite and is linked to an employer.
