The Committee for Health & Social Care is consulting on the draft Code of Practice for the Capacity (Bailiwick of Guernsey) Law, 2020.

The Code underpins the Law by setting out the practical details and processes which should be followed when performing duties and exercising powers under the Law.

This is a key part of the work currently being undertaken by the Committee to implement the Law in its entirety, having already brought into force the provisions relating to Lasting Powers of Attorney.

The Code also aims to empower people to make decisions about their lives wherever possible and to protect their human rights, while affording them the greatest care and respect. It will ensure that the Law is implemented across the Bailiwick in a consistent and practical manner, and it seeks to reflect current best practice and give clear and accessible guidance for those that need it.

The Committee wishes to encourage anyone who has an interest in capacity or will be affected by, or knows someone affected by, the draft Code to respond to this consultation. This may be as a worker in the health and care sector, a family carer or, most importantly, people who may be directly affected by the Law because they lack capacity to make important decisions. The Committee has therefore produced an easy read summary booklet of the Code so that all members of the community can understand it.

The Committee for Health & Social Care welcomes any responses via this form by 17 March 2023.
