EU nationals will now need to have the appropriate clearance under the Immigration Act, 1971 (Bailiwick of Guernsey) and hold a Population Management document to live and work in Guernsey.

*references to the EU for these pages also relate to national of the EEA (Norway, Iceland and Liechtenstein) and Switzerland

  • I employed an EU national on or before 31st December 2020

    • EU nationals who moved to Guernsey on or before 31 December 2020 are eligible for the Guernsey EU Settlement Scheme, which protects their rights to continue living and working in Guernsey.
    • You can continue employing these staff provided they have applied for settled /pre-settled status AND they hold a valid Population Management Permit or Certificate (see below).
    • How to check employees have the appropriate immigration permission
    • Employers should do one of the following;
      • be satisfied that the employee was in Guernsey before 1 January 2021 and eligible to the settlement (in this case, you should remind them to apply to the scheme by 30 June 2021); or
      • request that the employee shows you a document to confirm they have been granted settled or pre-settled status. This will be a hard copy letter issued by Immigration in Guernsey, or may be digital confirmation if issued by another jurisdiction.
    • Employees with pre-settled status
    • Employees who have been granted pre-settled status will need to apply for settled status once they have completed 5 years residence in Guernsey. Their permission granting pre-settled status gives a date when they may be eligible to apply, if still resident in Guernsey.

    • Employees not yet registered to the scheme
    • Employees who have not yet registered for the scheme will need to apply before 30 June 2021, and you will need to request that the employee shows you a document to confirm they have been granted settled or pre-settled status.

    • Generally if an individual is not residentially qualified under the Population Management Law, and in your employment, they will need to hold an Employment Permit.

  • I am employing an EU national who currently lives (and started on or before 31st December 2020) in the UK, Jersey or the Isle of Man 

    • EU nationals who started living in the UK, Jersey or Isle of Man on or before 31 December 2020 are eligible for the EU Settlement Scheme, which protects their rights to continue living and working in the UK, Guernsey, Jersey and the Isle of Man.
    • You can employ these staff provided they have been granted settled /pre-settled status AND they hold a valid Population Management Permit and Certificate (see below).

    • Employers should do one of the following;

The application is free and easy to do. They will need to submit their application in person to our office.

    • Employers should request that the employee shows you a document to confirm they have been granted settled or pre-settled status. This may be a hard copy or digital confirmation issued by Immigration in the UK, Jersey or Isle of Man.
    • Employees with pre-settled status
    • Employees who have been granted pre-settled status will need to apply for settled status once they have completed 5 years residence. Their permission granting pre-settled status gives a date when they may be eligible to apply, if still resident in Guernsey.

  • I am employing an EU national who currently lives (and started after 1st January 2021) in the UK, Jersey or the Isle of Man 

    • From 1 January 2021 EU nationals coming to Guernsey for employment, require a Visa AND a Population Management Permit or Certificate (see below) prior to arrival. 
    •  Visa
    • The EU national should already hold a visa in their passport. However, this visa may not be valid for the Bailiwick of Guernsey. The applicant may need to apply for further leave to remain through the Guernsey immigration office. Please contact the immigration office on immigration@gba.gov.gg with a copy of their current visa.

  • I am employing an EU national who has never lived in Guernsey before or does not have pre-settled/settled status

    • From 1 January 2021 EU nationals coming to Guernsey for employment, require a Visa AND a Population Management Permit or Certificate (see below) prior to arrival. 
    • Visa application

      As part of the visa application process, the employee will have to submit biometrics. Currently this will require the EU national to attend a visa application centre in the country of their residence.

    • The visa application is made through the UK Government online system. The fee is dependent on the validity of the Population Management Employment Permit (please note the fees below are exclusive of pdf icon Population Management Permit or Certificate fees [477kb]):

    • Short Term Visa (Up to 12 months)£244
      Medium or Long Term Visa (over 12 months)£610

  • Is the EU national you are employing bringing their family with them to Guernsey?

  • The employee is a British or Irish national, what do I need to do?

    • British and Irish nationals can continue to come to the Bailiwick of Guernsey without any restrictions under the Immigration Act, 1971 (Bailiwick of Guernsey).
    • Under the Population Management Law, anyone working and/or living in Guernsey is required to hold a Population Management Permit or Certificate to do so. You can ask the employee for a copy of their Population Management Permit or Certificate. Should they not hold a valid Permit or Certificate, you may be able to make an Employment Permit application on their behalf.

  • The employee is not an EU, British or Irish national, what do I need to do?

    • The current process will remain unchanged, with a separate immigration work permit application continuing to be required. Click here to find out more information about immigration clearance in Guernsey.
    • In addition to immigration clearance to enter Guernsey, your employee will need to hold a Population Management Permit or Certificate to live and work in the island. Click here for more information. If they already live in Guernsey, you can ask the employee for a copy of their Population Management Permit or Certificate. Should they not hold a valid Permit or Certificate, you may be able to make an Employment Permit application on their behalf.
