Liquor Licensing Alterations

Please complete this form to apply for Alterations to your licensed premises.

All applications for alterations, can be presented to the Tuesday Ordinary Court at 9.45am (applicants need to arrive for 9.30am) without the need to employ an advocate but you can employ one should you wish to. This is for all the unopposed, straightforward applications.

Please note that a 28 days notice is required to process those applications.

Once the application is received, an invoice for the application will be issued to the Licensee. Additionally, a copy of the application will be forwarded to the Parish Constables and following payment of their fees, you will be advised of the Court date.

Please note that an incomplete application may cause a delay in the Court appearance.

Should you wish to alter your licensed premises, you will need to make an application prior to undertake the work.

On completing the form you should receive a pop-up message advising you that your form has been submitted. If you do not receive this message your form may not have been reached us, please contact homeaffairs@gov.gg to check.

  • Do I need to apply for Alterations

    • Should you wish to alter your licensed premises, you will need to make an application prior to undertake the work.
    • If you wish to -
    • (a) increase the floor space available for the use of persons consuming intoxicating liquor,
    • (b) result in the concealment from observation of any part thereof used for the sale, supply or consumption of intoxicating liquor,
    • (c) affect the means of access to, and egress from, the licensed premises from or to -
    • (i) any other adjoining premises, or
    • (ii) any adjoining public place, or
    • (d) otherwise materially alter the structure of the licensed premises,
    • you will need to apply for alterations to the Royal Court.       
  • Documents to be submitted

    • A copy of the plan of the premises (following the requirements listed in the tab below) 
    • A copy of the Planning Control / Building Control permit (if applicable)
  • Submission of Plans

    • When the premises have not previously been licensed, or you intend to change the licensed area, the application must be accompanied by one copy of a plan of the premises meeting the following criteria:-
    • 1.      The plan must be neat, accurately drawn to scale and up to date. An architectural survey is not necessary (unless the circumstances require this);
    • 2.      The plan must clearly show the location and layout of the premises;
    • 3.      The plan must clearly show the alterations and the proposed new layout;
    • 4.      The plan must include the detail specified in Rule 2 of the Royal Court (Liquor Licensing) Rules 2006, in a reasonable way, appropriate to the premises concerned. When the premises include residential accommodation, the plan should cover the areas open to the public;
    • 5.      Areas must be indicated as follows:-
    • a.      The boundary of the premises is to be outlined in RED;
    • b.      Where the licence has specified the use of particular areas as a bar, restaurant or café, they must be clearly identified as such;
    • c.       Areas used as a bar must be outlined in GREEN;
    • d.      Any area used as a bar, in respect of which an Under 18's Permit has been granted, must be outlined in BLUE and hatched in BLUE.
    • 6.      The plan must be certified as accurate and signed by the (prospective) Licensee
  • Gazette Notice

    • If be making your application, you are also altering your Under 18's Permit, you will need to publish a notice in the Gazette Officielle and to display the same notice on the premises.
    • The notices to be published in the Gazette Officielle and displayed outside is attached.
    • The legal requirement are as follow -
    • 1. Publish a notice in the Gazette Officielle on two weekly occasions prior to the date of their court hearing; and
    • 2. Put up a notice on or near to the premises, where it can be easily read by members of the public, e.g. on the premises window, at least 14 clear days prior to the date of their court hearing;
    • A notice will also need to publish a notice in the Gazette Officielle and to display the same notice on the premises if you are applying for an Under 18's Notice.

  • Fair Processing Notice

    • In order for your application to be processed, the Office of the Committee for Home Affairs will process the personal information submitted on this form. The information that you supply on this form will be shared with the Guernsey Royal Court in preparation for the Royal Court to consider your application. We may share your information with other relevant agencies as may be required in order complete the application process. The Office of the Committee for Home Affairs acknowledges its obligations under the Data Protection Law, 2018.
