Under the Administrative Decisions (Review) (Guernsey) Law, 1986 (called "the Law" in this Application form), a person who wants to complain about an administrative decision (which may include an act or omission) made by a Committee of the States of Guernsey (including States Authorities, Boards etc), or a person acting on of behalf of a Committee, may apply to have that administrative decision reviewed by a Review Board.

When filling out this Application form, you should keep in mind the following:

Can you clearly identify and explain the administrative decision that you wish to challenge? It is difficult for the Complaints Panel to consider a complaint properly if it is not clear which decision(s), act(s) or omission(s) are being complained of.

Can you explain why the complaint justifies a review by the Review Board? This includes considering whether the decision, act or omission cannot, as a matter of fact, be reconsidered because e.g. it has been replaced by a further decision or the decision was correct, but the complaint relates to the time for it to be taken.

Can you provide evidence to the Complaints Panel to demonstrate that the complaint justifies a review? Although the Complaints Panel does not conduct a full investigation before deciding whether to refer the complaint to the Review Board, it is useful for it to consider any evidence e.g. relevant correspondence which may help it understand your complaint.
•
If you want to persuade the Complaints Panel that your complaint is not excluded under section 3 of the Law, can you explain the reasons why it should not be excluded? You do not have to explain why your complaint is not excluded under each of the section 3 factors, but if you do you may wish to show that there are exceptional circumstances to justify this or to argue that it is in the interests of justice for the Complaints Panel to refer it to the Review Board anyway.
