The States are asked to decide:-
Whether they are of the opinion to approve the draft Ordinance entitled "The Offences (Fixed Penalties) (Guernsey) Law, 2009 (Amendment) Ordinance, 2016", and to direct that the same shall have effect as an Ordinance of the States.
This proposition has been submitted to Her Majesty's Procureur for advice on any legal or constitutional implications in accordance with Rule 4(1) of the Rules of Procedure of the States of Deliberation and their Committees.
EXPLANATORY MEMORANDUM
This Amendment Ordinance inserts new offences in the Schedule of the Offences (Fixed Penalties) (Guernsey) Law, 2009 ("the 2009 Law").
The new offences are set out in section 4 of the Vehicular Traffic (Hospitals, etc.) Ordinance, 1985 ("the 1985 Ordinance") under which it is an offence to drive, ride or park a vehicle on controlled land at the Princess Elizabeth Hospital, the Duchess of Kent House, the King Edward VII Hospital or the Castel Hospital in contravention of the 1985 Ordinance.
Consequently, police officers and members of the Special Constabulary will be permitted to use their discretion to issue fixed penalty notices under the 2009 Law in relation to these "Band A" fixed penalty offences which will carry a penalty of £40 (or £30 if paid within 7 days).
